Terms of Service

These Terms of Service ("Terms") govern your use of the Sportsball website, mobile application, and related services (the "Service") operated by Kim Wormley dba Sportsball Games, a California sole proprietor ("Sportsball," "we," or "us"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the Service.
1. The Service
Sportsball provides group prediction games: pick em, squares, props, and brackets. Jelly beans, ranks, and leaderboards are entertainment and bragging rights only. They have no cash value, cannot be bought, sold, or redeemed, and are not a stake, chip, or prize purse.
Host fees (when shown) are charges for software features such as publishing a private game or launching a league slate. They are not an entry fee into a wager, pool, or betting contest.
No real-money gambling
The Service is not a sportsbook, daily fantasy contest, betting exchange, or pool-holding service. You must not, on or through the Service, or by using Sportsball games, scores, or rosters as the basis for a wager:
- Place, accept, record, settle, or pay a bet
- Hold or distribute a pot, or charge a rake
- Adapt "for fun" play into real-money gambling, including cash, Venmo, PayPal, crypto, or any other value
We do not authorize or condone off-platform wagering connected to Sportsball play. If you do it anyway, you do it without our permission, at your own legal risk, and we may suspend or terminate your account, games, and access, including where we reasonably suspect illegal gambling. Sportsball is based in California. You are responsible for complying with the laws that apply to you, including California Penal Code section 337a where it applies. These Terms do not make Sportsball a licensed gambling operator and do not waive any law.
2. Accounts and eligibility
You must be at least 13 years old to create an account. You must be at least 18 to host a private game, pay a host fee, or claim a Sportsball-sponsored prize. You are responsible for activity on your account.
On the web, you may play some guest games (for example squares) with a display name and no account. Guest play does not include an email address. The native mobile app requires a signed-in account.
Private leagues and some private games require a Sportsball account. When you join a private game while signed in, the host of that game may see your email to operate the game. See the Privacy Policy and Host Terms.
3. Host payments
Playing is free. Hosts may pay a fee shown in-product to publish some private games or launch private league slates. Web payments are processed by Stripe. Mobile in-app purchases are processed by Apple or Google. We do not store full payment card numbers.
Refunds for host fees follow the rules of the payment platform (Stripe, Apple, or Google) and any in-product notice at checkout. Withdrawing a slate does not automatically refund a purchase.
4. Public prizes
Some public global challenges may offer prizes. Prize eligibility and official rules are described in our Prize Rules and on the game when prizes are in play. No purchase is necessary for players to enter a public challenge. Promotions are void where prohibited. We may refuse or cancel a prize where sports-adjacent promotions or skill contests are unlawful, including by restricting eligibility by location.
5. Acceptable use
You agree not to harass others, cheat, scrape the Service, spam, or use the Service for illegal gambling operations. See Acceptable Use.
6. Intellectual property
The Service, including Sportsball branding, is owned by Sportsball Games. You retain rights to content you submit (picks, display names, messages) and grant us a license to host and display it as needed to operate the Service.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." We do not warrant uninterrupted or error-free operation. Live scores, schedules, odds, results, and leaderboards depend on third-party sports data feeds and other APIs. We do not warrant that those feeds are timely, complete, or accurate, or that they will be available during an outage, delay, correction, or vendor change. Scoring is for entertainment and in-product standings. We may adjust scoring when source data is revised.
8. Limitation of liability
To the fullest extent permitted by law, Sportsball will not be liable for indirect, incidental, special, or consequential damages, or for off-platform money arrangements among users. Our total liability for claims relating to the Service is limited to the greater of (a) amounts you paid us for host fees in the three months before the claim or (b) fifty US dollars.
9. Termination
We may suspend or terminate access if you violate these Terms. You may delete your account in Settings. Deletion is best-effort; copies a host already exported cannot be recalled.
10. Changes
We may update these Terms. For material changes we will require a new in-product acknowledgment (clickwrap) before you continue with a signed-in account. We will also post the updated Terms on this page with a new "Last updated" date. Non-material changes (for example clarifications or contact details) may take effect when posted.

These Terms are governed by the laws of the State of California, excluding conflict-of-law rules, without limiting any non-waivable consumer protections that apply to you.
12. Arbitration and class-action waiver
If a dispute is not resolved informally, you and Sportsball agree to resolve it through binding individual arbitration, except that either of us may bring a claim in small-claims court if it qualifies. You may opt out of arbitration by emailing privacy@joinsportsball.com within 30 days after you first accept these Terms.
YOU AND SPORTSBALL WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION, to the extent permitted by law. This section does not apply where prohibited, including where a non-waivable consumer right requires a court.
